Enhanced Gang Affiliation Charges and Bail System Improvements with SBI Oversight
Suggestions in focus of gang members and crimes, fixing loopholes that could be used to get out of being arrested or charged with a crime, and some SBI additions.
Gangs are becoming larger in Ventura, however, there are no actual charges of being affiliated or anything close to it.
Another addition is the bailing system that was talked about. It also included longer sentences for charges, so this would be sick for people that don't want to wait in jail for a large amount of time.
An addition to SBI on requests behalf a false charges or falsely putting a person in prison, an SBI agent should be able to release or pardon the person on behalf of a staff member so this isn't abused. There have been many instances where a person has been false imprisoned or additional charges that are not correct have been added intentionally. This makes a good addition in case someone is abusing the power and after a person is charged with crimes they did not commit.
Charges that should be added that are in Texas:
- Engaging in Organized Criminal Activity (Texas Penal Code § 71.02) - commit or plan a crime with the intent to participate as a member of a criminal street gang or a "combination" Criminal Conspiracy (Texas Penal Code § 15.02) - to plan a felony with other people, even if the planned crime is never actually completed. Directing Activities of Criminal Street Gangs (Texas Penal Code § 71.023) - it makes it a first-degree felony to be a gang leader, financier, or supervisor who orders or directs other members to commit serious crimes. No "Ignorance" Defenses (Texas Penal Code § 71.03) - (DEFINITION) gang members cannot escape organized crime charges by claiming they didn't know the other members, that the gang's structure changed, or that the group was disorganized.
