There are a lot of people that tend to grab helicopters just to fly them out to the Apache and jump out. Most passengers won't have the opportunity to jump in the pilots seat in time before the heli crashes. I would suggest that if the pilots seat is determined to be empty, the "Change Seat" button shouldn't swap your seat but instead prioritize the drivers seat so that you can take control and try to recover before the heli is destroyed and wasted. This has become an epidemic ever since the Apache was added and I have yet to have a round since the latest update where this hasn't been the case.
