If the pilot/driver seat of a vehicle is empty, the first time that you press switch seats should prioritize switching to that seat. For helicopters, moving into the pilot seat should also cooldown the switch seats button so that you don't accidentally switch after taking the pilot seat, allowing for some chance of recovery.
